These Terms of Service ("Terms") govern your access to and use of the Boostersocial website, mobile application, and related services (collectively, the "Service"). The Service is operated by Boostersocial ("Boostersocial," "we," "us," or "our"). By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

1. Eligibility

You must be at least 13 years of age to use the Service. If you are between the ages of 13 and the age of legal majority in your jurisdiction, you may only use the Service with the consent of your parent or legal guardian, who must agree to be bound by these Terms on your behalf. By using the Service, you represent and warrant that you meet the foregoing eligibility requirements.

2. Description of the Service

Boostersocial is a content-engagement platform that allows TikTok users to support one another by watching, liking, and following each other's content. Users earn virtual coins by engaging with other users' TikTok videos, and may spend those coins to boost the visibility of their own TikTok videos. The Service relies on third party platforms, including TikTok, and is dependent on their availability and terms of use.

3. Accounts

To use the Service, you must sign in with your TikTok account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account. We are not liable for any loss or damage arising from your failure to protect your login credentials.

4. Virtual Coins

Coins are virtual in-Service rewards earned by engaging with other users' content. Coins have no monetary value, are not a form of currency, and cannot be purchased, sold, or exchanged for real money or any other goods or services. We may, in our sole discretion, adjust coin earning rates, costs, or balances. Coins may be forfeited if your account is terminated for violation of these Terms.

5. Acceptable Use and Prohibited Activities

You agree not to, and not to attempt to:

• Use bots, scripts, automated tools, or any form of manipulation to artificially earn coins or boost videos;
• Create multiple accounts to circumvent restrictions or limitations;
• Engage in any activity that violates TikTok's Terms of Service or Community Guidelines;
• Post, link, or engage with content that is illegal, infringing, hateful, harassing, or otherwise objectionable;
• Attempt to gain unauthorized access to the Service, its servers, or other users' accounts;
• Use the Service for any fraudulent or unlawful purpose; or
• Interfere with or disrupt the operation of the Service.

6. Third-Party Services

The Service integrates with TikTok and may reference other third-party websites or services. Boostersocial is an independent platform and is not affiliated with, endorsed by, or sponsored by TikTok or any other third party. Your use of TikTok and any other third-party service is subject to that provider's own terms and privacy policies. We are not responsible for the content, policies, or actions of any third party.

7. Intellectual Property

The Service, including all software, text, graphics, logos, and other content provided by Boostersocial, is owned by or licensed to Boostersocial and is protected by applicable intellectual property laws. You may not copy, modify, distribute, sell, or create derivative works from any part of the Service without our prior written consent. Your own videos, profile information, and other content that you submit remain your property.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT RESULTS OBTAINED THROUGH THE SERVICE WILL BE ACCURATE OR RELIABLE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BOOSTERSOCIAL AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. THIS INCLUDES ANY ACTION TAKEN BY TIKTOK OR ANY OTHER THIRD PARTY AGAINST YOUR ACCOUNT. OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS ($100) OR THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify, defend, and hold harmless Boostersocial and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in connection with your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

11. Termination

We may suspend or terminate your access to the Service, in whole or in part, at any time and for any reason, including for violation of these Terms. Upon termination, your right to use the Service ceases immediately and any coins in your account may be forfeited. You may stop using the Service at any time. Sections that by their nature should survive termination shall survive, including Sections 4, 7, 8, 9, 10, and 13.

12. Changes to These Terms

We may update these Terms from time to time. When we do, we will post the revised Terms on this page and update the "Last updated" date at the top of these Terms. Your continued use of the Service after any changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, please discontinue use of the Service.

13. Governing Law and Disputes

These Terms are governed by the laws of the jurisdiction in which Boostersocial is established, without regard to its conflict-of-law provisions. Any dispute arising out of or relating to these Terms or the Service shall be resolved through good-faith negotiations between the parties. If the dispute cannot be resolved through negotiation, either party may pursue available legal remedies in the competent courts of that jurisdiction.
